Loitering, prowling or wandering on another's private property, without visible or lawful business with the owner or occupant is a misdemeanor under California Penal Code Section 647 (h). Additionally, it is a misdemeanor within the City of Fort to remain on private property or business premises, if notified by the owner or lessee to vacate the property under Fort Bragg’s Municipal Code Section 9.58.010.

A current and complete Trespass Letter gives permission to City of Fort Bragg Police Officers to enter private property without contacting the owner first and enforce trespass violations. Properly posted “No Trespassing / Private Property” notification signs on the property, provide a warning to individuals on the property that they trespassing and must vacate the property. If the property is not posted with such signs and there is a current Trespass Letter on file, an officer may issue the warning to vacate on your behalf and, if the individual remains, remove or arrest the trespasser. If an arrest is made, the property owner/manager must agree to cooperate with any legal proceeding necessary to assist in the prosecution of any arrest made pursuant to the Letter. The Letter expires after one (1) year and must be resubmitted each year.

An Individual Trespass Letter, allows the owner or lessee to identify a particular individual or individuals, who are trespassing if found on the property, and gives permission to the Police Department to enforce trespass violations.
